How to remove UBWs?

The Buildings Department (BD) may issue Statutory Orders to the owners concerned requiring removal of the actionable items of UBWs, or statutory warning notices registrable against the property title.

Statutory Removal Orders

If the statutory order is received, building owners should appoint building professionals and/or contractors to advise and carry out the removal works. The removal works falling within the description of minor works items can be carried out under Minor Works Control System.

Who is eligible to be employed for removal of UBWs?

According to the type of demolition work in the relevant removal order specified by BD, different type of Building Professionals should be appointed to carry out the work and to advise and ensure that necessary safety measures are provided.

Involving the demolition of a building or of any substantial or significant part of a building
  • Authorized Person (AP), Registered Specialist Contractor (RSC), and Registered Structural Engineer (RSE) should be appointed to carry out the work and to advise and ensure that necessary safety measures are provided.
NOT involving the demolition of a building or of any substantial or significant part of a building
  • Registered Contractor (RC) should be appointed to carry out the work.
  • An AP or RSE should be appointed to ensure the necessary safety measures are provided.

A list of Authorized Persons, Registered Structural Engineers and Registered Geotechnical Engineers who had expressed an interest in providing services to building owners in respect of building repairs and removal of UBWs as well as Registered Contractors are available for free inspection at the Buildings Department.

Common questions

When the "minor works" are to be carried out on common parts of a building, the Person who Arranged the Minor Works to be Carried Out (PAW)(owners or owner's agents) or his appointed personnel (i.e. the "prescribed building professional" or "prescribed registered contractor") is strongly recommended to consult the co-owners, the Owners Corporation and/or the property management company (where applicable) before the commencement of works. Civil liabilities under the Deed of Mutual Covenant should be noted.

Statutory Warning Notices

For UBWs which do not fall within the actionable items of UBWs, the BD may issue Statutory Warning Notice registrable against the property titles under the Buildings Ordiance.

Actions to be taken by Building Owners

Building owners may consider joining the Household Minor Works Validation Scheme so as to retain the following types of minor UBWs erected before 31 December 2010:

  • drying racks
  • canopies
  • supporting structure/metal frames for air conditioners

Enforcement action to remove these validated minor works items will not be taken by the BD unless they become dangerous.
