Minor Works Contractors (RMWC)

(For details, please refer to PNRC 69.)

Minor works contractors who are registered in the name of an individual self-employed worker for carrying out various items of class III minor works are to be referred to as RMWCs (Ind).

Step 1: Prepare Record of Qualification and Experience

You should:

  • prepare a documentary proof of ability and skills to personally carry out the minor works item(s) in the application
  • have completed a Class III Minor Works Training Course

Notes:

The person registered as an RMWC (Ind) may be employed by a RMWC/RGBC/RSC to act as the Authorized Signatory (AS) but he/she should not be the sole proprietor, partner or technical director of the company simultaneously.

Any applications for restoration to the register submitted 2 years after the date of the expiry of the registration will be considered as new applications.

Registration Card issued before 15 February 2016 is still valid up to the date of expiry of registration.

A minor works contractor, who is registered in the name of a company (including owners' corporations, sole proprietorship and partnership) for carrying out various types and classes of minor works, is to be referred as RMWC (Co).

Every RMWC (Co) is required to appoint:

  • a minimum of one Authorized Signatory (AS) to act for the applicant for the purposes of the Buildings Ordinance (BO)
  • a minimum of one Technical Director (TD) for a corporation to perform the following duties:
    1. have access to plants and resources
    2. provide technical and financial supports for the execution of works
    3. make decisions for the company and supervise the AS and other personnel(s) for the purpose of ensuring the works are carried out in accordance with the BO

Step 1: Prepare Company Documents

You should prepare:

  • a copy of the current Business Registration Certificate (IRDB101) issued by the Inland Revenue Department (IRD)
  • a copy of the updated certified extracts of information on the business register (IRBR 152) issued by the Business Registration Office of the IRD
  • a copy of the current annual return (Form NAR1) to the Companies Registry) and a statement on the management structure if you are a corporation
  • An original Form RR9
  • documentary proof for access to plants and resources

Step 2: Appoint AS/TD

You should obtain:

  • the required qualification and experience (For details, please refer to Appendix G and H of PNRC 69)
  • if you are an individual company, you must be the AS. No TD is required. In addition, you must not be a registered Minor Works Contractor (Individual) (RMWC(Ind))
  • if you are a partnership company, any partner authorized by all the other partners can be the AS. No TD is required. In addition, you must not be a RMWC(Ind)
  • if you are a corporation, the AS must be appointed by the board of directors and the TD must be a director appointed under the Companies Ordinance (CO) and be appointed by the board of directors. You may apply for AS and TD at the same time, given that you meet both requirements. The appointed TD must not be a RMWC(Ind)

Note:

A person who has been accepted by the Building Authority (BA) as the AS or TD for an RMWC(Co) will not be accepted as a key personnel (AS, TD, or an Other Officer as stated in Practice Note for Registered Contractors 38 ) for another contractor simultaneously for the registration.

  • for application involving Class I minor works, it will be referred to the registration committee for consideration. As such, the AS nominated by the applicant, or where necessary, the TD, will represent the applicant to attend an interview. The interview will normally be arranged within 3 months after the submission and the applicant will be notified of the result within 3 months after the interview
  • for application NOT involving Class I minor works, the application in general will not be referred to the registration committee except there are special circumstances. The applicant will be notified of the result within 3 months after the date of submission

  • a duly completed Specified Form BA25C
  • a resolution from the board of directors for the appointment of the AS/TD (if applicable)
  • personal documents of AS/ TD including
    1. a copy of HKID card with specimen signature
    2. an original Form RR10 (for AS)
    3. an original Form RR10A (for TD)
    4. academic qualifications
    5. a Curriculum Vitae (CV) (for Class I only)
    6. working experience in related fields
    7. experience for managing a building contractor (for TD)
  • a checklist CL-BA25C and its required information
  • the prescribed fee (valid for the remaining period of the registration)

Step 4: Attend Interview if Necessary

  • applications for renewal/restoration should be submitted within the specified time limit, or the application will not be accepted

  • a checklist CL-BA25B and its required information
  • the prescribed fee for a period of 3 years from the date of issue
  • any applications for restoration to the register submitted 2 years after the date of the expiry of the registration will be considered as new applications

Step 4: Submit Latest Company Information

  • a copy of the current Business Registration Certificate (IRDB101)
  • for an individual or a partnership, a copy of the updated certified extracts of information on the business register (IRBR 152)
  • for a corporate, a copy of the current annual return (Form NAR1) to the Companies Registry (CR)

Step 5: Attend interview if necessary

  • the AS and, where necessary, the TD, shall on behalf of the applicant attend the interview by the Minor Works Contractors Registration Committee (MWCRC) (for details of the interview, please refer to Appendix O of PNRC 69)
  • The interview will normally be arranged within 3 months after the submission. You will be notified of the result within 3 months from the date of the meeting of the registration committee
