The Enactment of Building (Refuse Storage and Material Recovery Chambers and Refuse Chutes) (Amendment) Regulation 2008

Outline
The Building (Refuse Storage and Material Recovery Chambers and Refuse Chutes) (Amendment) Regulation 2008 (¡§Amendment Regulation¡¨) imposes a mandatory requirement for the provision of a refuse storage and material recovery room on every floor of a new domestic building or the domestic part of a new composite building. Such requirement will, however, be exempted in the following buildings or parts of buildings:

a hotel, guesthouse or boarding house;

a domestic building or composite building with one staircase only;
-
a domestic building designed for occupation by one single family only and with not more than 3 floors designed for habitation;
-
a composite building the domestic part of which comprises not more than 3 floors and is designed for habitation by one single family only;
-
a domestic building or composite building on a site of an area of not more than
500m2;
-
a floor not for habitation such as clubhouse, carpark or refuge floor;
-
a floor where a refuse storage and material recovery chamber or a material recovery chamber has been provided; and
-
the refuse storage and material recovery room will only need to be provided on one of the floors of multi-floor units, e.g. duplexes.

Benefit of the Amendment Regulation
New domestic buildings and the domestic parts of new composite buildings will have a refuse storage and material recovery room on every floor. It will be more convenient for residents to separate domestic waste at source and enhance collection of recyclable materials.

Implementation
The Amendment Regulation will come into effect on 1st December 2008. It will not be applicable to developments of which building works including substructure are under construction or consent to commencement of such works had been given by the Building Authority before that date.
